PROCEPT BioRobotics recognizes the importance of protecting the privacy of the individuals with whom we interact.

This Privacy Notice describes the practices that we follow at PROCEPT BioRobotics regarding the personal data we collect, use and disclose for different purposes as well as how we ensure personal data remains protected from the moment we collect it until we dispose of it. We also discuss what rights you have over your personal data and how to contact us when you have questions or concerns specific to the management of your personal data.

What is personal data?

Personal data means any information relating to an identified or identifiable individual; this refers to a person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that individual.

Personal data collection and processing at PROCEPT BioRobotics

We collect and process personal data for different purposes:

  • When you have a complaint or question. If you have questions or complaints about our products, we collect personal data such as your name, email address, phone number and details about the procedure where our products were used. We use this data to support healthcare professionals and patients, to document quality investigations, adverse event reporting and for research & development.
  • When you contact us. If you send us an email or you call us directly, we collect personal data from you such as your name, email address, phone number and the reason for your communication. We use this data to respond to your inquiry or provide you with the information that you are looking for.
  • When you navigate our websites.When you visit any of our websites, we automatically collect your IP address, browser type and the pages that you navigate to. We use information about our website visitors to improve our website usability and experience. Refer to our Cookie Policy for more details.
  • When you sign up for communications with PROCEPT BioRobotics. If you want to be updated about our products, you may sign up for our newsletter by providing your name and email address.
  • When you provide user feedback. We send requests for feedback to healthcare professionals and if you consent to provide us with your feedback, we collect your name, your practice or hospital name, your specialty and your contact information including email address and phone number.
  • When you share your stories about your Aquablation® therapy experience. We use the information you share with us to contact you to discuss the best way to include your Aquablation® story as part of our success stories.
  • When you visit our Aquablation® website, we collect your information to help you find a urologist in your region, respond to any questions you have regarding Aquablation® therapy or to help you determine the severity of your symptoms through the quizzes we have available for you.
  • When you are interested in finding a healthcare professional. If you are looking for a referral to a urologist through the Aquablation® website, we will help you find a urologist by obtaining your location through your browser IP address or by the location you enter on the Aquablation® website’s form.
  • When you attend an event or conference. We collect your name, your specialty, the name of your practice and address, your email address and your phone number in order to provide you in the future with product information relevant to you.
  • When you apply for a job at PROCEPT BioRobotics. We collect your name, email address, phone number, resume, LinkedIn profile and if you choose to do so, your gender and ethnicity. We use this information to determine if your profile satisfies the requirements of the role that you are applying for.

Our policy is not to collect personal data from children under the age of 13. If you believe that a child under the age of 13 may have shared their personal data with PROCEPT BioRobotics, please contact us and we will remove their data immediately.

Legal basis for processing personal data

PROCEPT BioRobotics only processes personal data if there is a legal basis for processing. The legal bases that we rely on are:

  • Legitimate interest from you. To provide you with the information you request when you contact PROCEPT BioRobotics or when you apply for a job with us.
  • Legitimate interest from PROCEPT BioRobotics. To provide you with a better navigation experience when you visit our website or to share with you information that you need about our products.
  • Explicit consent. To provide you with news and information about our products or to grant PROCEPT BioRobotics the right to use your Aquablation® therapy success story.
  • Legal or regulatory obligation. If there is a quality issue or adverse event, we are required to report it to agencies such as the Food and Drug Administration.

Personal data disclosure at PROCEPT BioRobotics

PROCEPT BioRobotics discloses personal data to the following parties under specific circumstances:

  • To PROCEPT BioRobotics’ employees in order to fulfill your request.

  • To authorities as required by law, court order, legal process or government or regulatory requirement or to protect the safety, rights, or property of the public or PROCEPT BioRobotics.

PROCEPT BioRobotics is committed to protecting the personal data we collect, process and disclose. We maintain appropriate safeguards and take reasonable steps to protect personal data, ensure that we limit its use and disclose it only to the parties that have a legitimate reason to have access to it.

We ensure that all the parties that we disclose personal data to, internal and external to PROCEPT BioRobotics, have contractual obligations to protect the security and the confidentiality of personal data.

Personal data storage location

Most of PROCEPT BioRobotics systems reside in the United States. If you reside in a different jurisdiction the personal data that you share with PROCEPT BioRobotics will be transferred to the United States, where data protection laws may differ from the ones in your region.

PROCEPT BioRobotics ensures that all personal data is protected regardless of where it is stored and we ensure, through legal means, that the third-parties we disclose your personal data to afford similar protections to your personal data.

Personal data retention

PROCEPT BioRobotics retains personal data only for the period of time that is necessary for the purpose for which it was collected.

  • For contact requests, PROCEPT BioRobotics retains the data for 11 years after the request has been fulfilled.
  • For data collected for the purpose of regulatory or legal requirements such as complaints, PROCEPT BioRobotics will retain it for 11 years after it has been collected.
  • For data collected while you navigate the PROCEPT BioRobotics websites including the Aquablation® site, refer to our Cookie Policy.
  • If you sign up through our website or at an event to receive information about PROCEPT BioRobotics products and subsequently you withdraw your consent, we will keep your contact information 11 years
  • If you provide us with your feedback about PROCEPT BioRobotics products, we will retain the information you share with us for 11 years for the purpose of quality and regulatory requirements.
  • For the data you share through the Aquablation® site symptoms quizzes, we do not store or retain the information you provide after you complete the quiz.
  • If you apply for a job at PROCEPT BioRobotics but you are not a successful candidate, we will retain your resume and contact information for 11 years to let you know about future opportunities that may fit your profile.

Personal data rights

Subject to any exceptions provided by law, PROCEPT BioRobotics provides individuals with the right to exercise the following requests with respect to their personal data:

  • You have the right to access the personal data that PROCEPT BioRobotics maintains about you.
  • You have the right to request deletion of your personal data, update or correct your data, object to processing of your data, ask us to restrict processing of your data or request portability of your data. On each particular case we will inform you of the consequences of your request and if there are any exemptions to honoring your request based on legal, regulatory or contractual requirements.
  • If PROCEPT BioRobotics has collected and processed your personal data based on your explicit consent, you have the right to withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing PROCEPT BioRobotics conducted prior to your withdrawal.
  • You have the right to be notified about a data breach that may impact the integrity, availability or confidentiality of your personal data. Refer to our data breach notification section for more details.
  • You have the right to complain to a data protection authority about PROCEPT BioRobotics collection and processing of your personal data. However, we would appreciate if you gave us the opportunity to handle your complaint internally before contacting a data protection authority.

Personal data breach notification

We have put procedures in place to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so. We will contact you through the email address we have on file or by posting a notice on our website, if required.

As a service to you, PROCEPT BioRobotics may provide links to third party websites through our own websites. These external websites contain information posted by organizations independent of us and are not under the control of PROCEPT BioRobotics.
